Refunds and Returns
- Mars Walker guarantees that all shoes will substantially conform to the specifications as detailed on the Website. Minor, non-material variations due to the handmade and custom nature of the product are not grounds for return or refund.
- Upon delivery, the Buyer must inspect the shoes for defects and conformity with the order. Returns are accepted only for defective or non-conforming shoes, provided that the shoes are unused, and the return is initiated within 30 days of delivery.
- Upon receipt of a compliant return, the purchase price and applicable shipping costs will be refunded using the original payment method.
- Due to the high degree of customization, bulk orders and custom orders in production (subject to Force Majeure events) are non-refundable unless Mars Walker is unable to ship the product within 120 days.
- Prototype and express prototype service fees are non-refundable due to the extreme personalization involved.

We operate a website at www.MarsWalker.Shop. Through our online platform, you can buy or custom order a pair of handcrafted shoes designed in Indianapolis, Indiana and made in Italy. Our final product is quality, comfort, and care. Our Customers are the beneficiaries. Our goal is to deliver this quality to people all around the world.
These Terms and Conditions (“Terms”) apply to your use of the Mars Walker website and services (“Services”). By accessing or using our Website or Services, you agree to be bound by these Terms. Mars Walker reserves the right, at its sole discretion, to modify these Terms at any time. The version displayed on the Website at the time of access will govern your use.
2. Interpretation

- Agreement: The Subscription Form and these Terms, which together constitute the entire agreement between you (“Customer”) and Mars Walker.
- Authorised Users: The Customer and any employees, agents, or independent contractors who are authorised by the Customer to use the Services and accompanying Documentation.
- Business Day: Any day that is not a Saturday, Sunday, or public holiday in The Netherlands.
- Buyer: A natural person, at least 18 years old, who orders shoes via the Webshop.
- Campaign: A project created by the Customer on the Website to sell a specific shoe design through the Webshop.
- Confidential Information: Information that is proprietary or confidential, clearly marked or identified as such.
- Customer: The natural person or entity with whom Mars Walker enters into this Agreement, whether in a B2B, B2B2C, or B2C relationship.
- Customer Data: Information provided by the Customer or Authorised Users in connection with the use of the Services.
- Effective Date: The date on which this Agreement becomes effective as specified in the Subscription Form.
- Initial Subscription Term: The initial period for which the Agreement is effective as set out in the Subscription Form.
- Normal Business Hours: 9:00 am to 6:00 pm EST on each Business Day.
- Privacy Policy: Mars Walker’s policy regarding the collection, use, and storage of personal data.
- Sales Tax, VAT, or Similar: Taxes applied in accordance with the applicable laws in the relevant jurisdiction.
- Services: The online platform provided by Mars Walker to design and sell custom shoes.
- Subscription Form: The form available on the Website that, once completed and submitted, together with these Terms, constitutes your entire agreement with Mars Walker.
- Support Services Policy: Mars Walker’s policy for providing support related to the Services as available on the Website.

- Virus: Any software, code, file, or programme that may disrupt or otherwise adversely affect computer software, hardware, or networks.

- Cause damage or injury to any person or property.
The Customer shall indemnify Mars Walker for any breach of this section by itself or its Authorized Users. Mars Walker reserves the right to disable access to any content or service that violates these provisions.
3.2 Restrictions
The Customer shall not, except as permitted by law or as otherwise agreed with Mars Walker:
- Provide the Website or Services to third parties for commercial exploitation.
- License, sell, rent, lease, transfer, or assign the Services or the Website to any third party.
- Assist any person in obtaining unauthorized access to the Website or Services.
The Customer is responsible for preventing any unauthorized access to their account and must notify Mars Walker immediately if such unauthorized access occurs.
4. Mars Walker’s Obligations
Mars Walker undertakes to provide the Services with reasonable skill and care. We will ensure that production and delivery of custom shoes meet market standards, subject to possible delays due to planned maintenance, unscheduled maintenance, or events beyond our control (Force Majeure).
While we strive to provide an uninterrupted and error-free experience, Mars Walker does not guarantee that the Website will be available at all times or free from errors. Issues arising from individual device configurations, viruses, or third-party software are not within Mars Walker’s control. We recommend using an up-to-date web browser (e.g., Chrome) for optimal performance.
If the Website or Services do not conform to these obligations, Mars Walker will use commercially reasonable efforts to remedy the situation or provide an alternative solution, which shall be your sole and exclusive remedy.
5. Customer’s Obligations
The Customer shall:
- Accurately complete the registration process on the Website and be at least 18 years of age.
- Maintain the confidentiality of their login credentials.
- Provide Mars Walker with any information reasonably required for the performance of the Services.
- Comply with all applicable laws and regulations.
- Ensure that any Authorized Users adhere to these Terms.
- Maintain their own network connections and telecommunications; Mars Walker is not responsible for issues arising from these.
- Acknowledge that they do not acquire any rights in the shoes beyond those expressly granted in this Agreement.
6. Application, Registration, and Creation of Custom Shoes
A client may request Mars Walker to assist with custom shoe designs through our partner artisans in Italy. In which case, clients will be directed to a third-party Website and services. At which time all terms and conditions of the Creation of Custom Shoes relate to said third-party partners' terms and conditions. All submitted designs are subject to approval by Mars Walker and their third-party partners. Once approved, the shoe design will be made available for purchase and delivery.
Pre-orders require a set number of pre-orders—either three (3) or seven (7), must be sold before a shoe design is manufactures. As a result, delivery times may vary depending on, but not limited to, shoe style, details, materials availability, and shipping logistics, as specified by the campaign. If the required pre-order threshold is not met within 30 days, the campaign will not automatically enter production, and buyers will be refunded in accordance with our Refund and Returns Policy available on the Website. Mars Walker reserves the right, at its sole discretion, to proceed with production even if the pre-order goal is not reached.
7. Use of the Web shop by Authorized Users
Authorized Users may use third-party links on the Web shop that offer:
- B2B: Orders such as prototypes, bulk orders, or regular pre-orders for marketing, R&D, or resale purposes.
- B2B2C: Orders or pre-orders delivered directly to the final Customer using our e-commerce tools.
- B2C: Direct orders placed by final Customers.
In the future, Customer portals may be in place for ordering and rewards programs. Specific rules for rewarding, cashing out, or converting rewards credits will be provided within the Customer user dashboard.
8. Prices, Payment, and Refunds
8.1 Prices and Payment
- All prices are quoted in the applicable currency and include value-added tax (VAT) unless otherwise noted.
- Payment must be made in advance via accepted payment methods (credit card, PayPal, etc.).
- The Customer guarantees that all payment data provided is accurate. Mars Walker may request additional verification if necessary.
- In the event Mars Walker is unable to deliver your order within 56 days of placement, a full refund will be issued.

9. Intellectual Property Rights
The Customer acknowledges that Mars Walker owns all intellectual property rights in the Website, Services, and products—including all designs, concepts, patterns, and documentation—unless explicitly agreed otherwise in writing. The Customer is granted a limited, non-exclusive, revocable license to use and promote the products solely in accordance with this Agreement. This license does not confer any rights to reproduce, modify, or create derivative works except as expressly permitted.
Mars Walker reserves the right to use any content (including images, designs, testimonials, etc.) created or provided by Authorized Users for commercial purposes.
10. Exclusivity
Mars Walker holds exclusive rights for a period of seven (7) years from the publication (or submission) of a design to produce and distribute shoes or accessories created via our platform. The Authorized User grants Mars Walker a free license for the associated brand for five (5) years after publication.
While the Authorized User may sell shoes produced through Mars Walker via other channels, they must not produce or exploit the shoes through any party other than Mars Walker.
11. Confidentiality
Each party may receive Confidential Information from the other solely for the purpose of fulfilling its obligations under this Agreement. Confidential Information does not include information that:
- Is or becomes publicly known through no fault of the receiving party;
- Was lawfully in the possession of the receiving party prior to disclosure.
- Is independently developed by the receiving party without reference to the disclosing party’s Confidential Information; or
- Must be disclosed pursuant to law or a court order, provided that notice is given to the disclosing party where practicable.
Each party shall take reasonable measures to protect the confidentiality of the other’s Confidential Information. This obligation shall survive the termination of this Agreement.
